Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you", "User") and Sonisi AS, registered in Norway ("Sonisi", "we", "us"), governing your access to and use of the Influ8 product, including the website, applications and APIs (collectively, the "Service"). By creating an account or using the Service, you accept these Terms. If you do not agree, do not use the Service.

Influ8 is an AI-powered tool for creators. It analyses drafts of short-form video, captions and hooks, predicts likely performance, scores content against viral patterns, generates rewrites in your voice, surfaces trends and maintains a "Creator Memory" of your style. Predictions and scores are statistical estimates based on patterns in historical data and are provided for informational purposes only. We do not guarantee any specific outcome, reach, view count, engagement, follower growth or revenue.

• You must be at least 16 years old to use the Service.
• You are responsible for keeping your credentials secure and for all activity under your account.
• You must provide accurate information and keep it up to date.
• You may not share your account or resell access without our written consent.
• One person, one account, unless we explicitly allow team or agency plans.

You retain all rights in the content you submit to the Service ("User Content"), including drafts, videos, audio, captions, hooks, scripts and any data imported from your connected social accounts. By submitting User Content, you grant Sonisi a limited, worldwide, non-exclusive, royalty-free licence to host, process, transmit and display the User Content solely to operate the Service for you, including transcription, scoring, generating rewrites, and updating your Creator Memory. We do not use your User Content to train public foundation models.

You represent that you have all rights necessary to submit the User Content (including any voices, faces, music and trademarks featured in it) and that it does not infringe any third-party rights or applicable law.

When you connect TikTok, Instagram, YouTube, X / Twitter or LinkedIn, you also remain bound by the terms of those platforms. We access only the data and permissions you authorise. You can disconnect any platform at any time from your account settings. Sonisi is not affiliated with or endorsed by those platforms and is not responsible for their availability, changes to their APIs, or actions they take against your account.

The Service produces AI-generated text and scores. Output can be incorrect, biased or unsuitable for your context. You are solely responsible for reviewing and deciding whether to publish anything generated by or scored through the Service. Output is not legal, financial, medical or other professional advice. You will not present AI-generated content as having been verified or endorsed by Sonisi.

You agree not to:

• use the Service to generate illegal, defamatory, hateful, harassing, sexually exploitative, violent or deceptive content;
• generate impersonations of real people without their consent, or content designed to deceive about its AI origin in a harmful way;
• upload malware, scrape or reverse engineer the Service, or interfere with its operation;
• circumvent rate limits, paywalls, fair-use limits or access controls;
• use the Service to violate any third party's intellectual property, privacy, publicity or other rights;
• use the Service in violation of any applicable export-control, sanctions, platform rules or AI regulation (including the EU AI Act and the Norwegian Marketing Control Act).

We may remove content, suspend access, or terminate accounts that breach this section, with or without notice.

The Service offers free and paid plans. Some features (e.g. unlimited analyses, advanced memory, team seats) are reserved for paid plans. Paid subscriptions renew automatically until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and you keep access until then. Except where required by law, fees are non-refundable. Norwegian consumers benefit from the statutory 14-day right of withdrawal under the Right of Withdrawal Act (angrerettloven); by starting to use a digital service during the withdrawal period you may waive this right where we have informed you accordingly.

We may make experimental or beta features available. These are provided "as is", can change or be removed at any time, and may have additional usage limits. Feedback you provide about beta features may be used by us without restriction.

If you believe content on the Service infringes your copyright or other rights, contact contact@influ8.com with: (a) identification of the protected work, (b) the location of the allegedly infringing material on the Service, (c) your contact details, (d) a statement of good-faith belief that the use is unauthorised, and (e) confirmation that the information you provide is accurate. We will review and respond within a reasonable time.

The Service relies on third-party providers for hosting, payments, AI models and social-platform APIs. Their availability and behaviour can affect the Service. We are not responsible for outages, policy changes or output of third-party systems beyond our reasonable control.

The Service, including all software, design, trademarks (including "Influ8" and the Influ8 logo) and documentation, is owned by Sonisi AS or its licensors and is protected by intellectual property laws. Nothing in these Terms transfers any of those rights to you, except for the limited right to use the Service in accordance with these Terms. AI-generated output is provided to you to use for your own creator activities; you remain responsible for ensuring it does not infringe third-party rights.

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy of predictions and non-infringement. AI-generated output may be inaccurate, outdated or unsuitable; review it before relying on it.

To the maximum extent permitted by law, Sonisi's total aggregate liability arising out of or related to the Service in any 12-month period shall not exceed the amount you paid to Sonisi in that period, or one hundred Euros (EUR 100), whichever is greater. Sonisi shall not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, data, goodwill, audience reach or content performance. Nothing in these Terms excludes liability that cannot be excluded under mandatory law (including gross negligence, wilful misconduct, death or personal injury caused by negligence, or non-waivable consumer rights under Norwegian law).

You agree to indemnify and hold Sonisi harmless against claims, damages and costs (including reasonable legal fees) arising from your User Content, your use of the Service in violation of any social platform's terms, or your breach of these Terms or applicable law.

These Terms apply for as long as you use the Service. You may close your account at any time from account settings. We may suspend or terminate access if you breach these Terms, if required by law, or for legitimate operational reasons, in which case we will give reasonable notice where practical. On termination, your right to use the Service ends and your User Content will be deleted in accordance with our Privacy Policy.

Sonisi is not liable for failure or delay in performance caused by events beyond its reasonable control, including internet or infrastructure outages, attacks, AI-provider failures, social-platform API changes, strikes, war or government action.

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

These Terms are governed by the laws of Norway, without regard to its conflict of laws rules. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Oslo, Norway (Oslo tingrett), without prejudice to mandatory consumer protections in your country of residence. Consumers in the EU may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
